A year later, however, they were shocked when they discovered that a local resident had filed a complaint and that they had to apply for a building permit. The Ponters of Ferndale Road in Filton had bought the climbing frame in May last year as a surprise for their second-hand daughter`s birthday on eBay. Jenny said: «We received a knock on the door in mid-June from someone on the council who told us they had received a complaint about the climbing framework.» We were in total shock because we had it for over a year and we hadn`t received any complaints ourselves. The last thing we want to do is upset one of our neighbours. The complaint filed with South Glos pointed out that the 3.7-metre-high frame caused a loss of privacy for the occupant`s bedroom windows, compromising their view and having an overwhelming effect. It was also added that the structure overlooked the playground of Shield Road Elementary School. Following the complaint, the Ponters agreed to surround the tower with wooden slats and submit a building application to the council and purchase land register documents that cost a total of £200. The building permit for the climbing frame has now been granted and the Ponters say they are relieved by the decision. Jenny said: «It`s a lot of money to decide something that could have been solved by a simple conversation.» It was all simply very disappointing and incredibly stressful – and a complete waste of taxpayers` money.
The family has received at least five visits from South Glos Council – the most recent with up to 15 council officials and members of the planning committee. The construction application was recommended for approval to the official in charge of the case. However, Filton City Council expressed concern that the structure was «too high». Lesley Reuben said on behalf of Filton City Council: «The climbing frame is clearly too high. It would be the proposal of the city council that it be bought up to the height of the fence. Neighbor Debra Blake`s initial complaint stated, «The structure exceeds the height limit of 2.5 meters for such a wide structure and is not 2 meters from the border.» The tower is arrogant, with a very dense look. Although the planning officer noticed a loss of privacy and the applicant filled in the sides of the tower, there is still a loss of privacy from the raised platform or balcony. «The structure dominates the 6-foot fence. When children play on the structure, I have also seen adults on the structure. «We sleep in the room at the back of the house and have a loss of privacy.» A spokesman for the council said: «The construction application was submitted at the Development Control Committee (West) meeting on Thursday 3 March. November, approved, subject to the following condition that the «closed» element of the climbing frame on the south, west and north sides approved herein remains permanently closed.

It`s really a small community, so I was very surprised when the climbing frame went up as it clearly violated planning regulations – this is something you`ll find in Elm Park. I raised three guys – I`m not against them having a climbing frame, it`s just that the tower is way too high. When Jenny and Mike finished their expansion, it took about a year – there were a lot of problems, but I didn`t complain about it once. So I`m a little upset that it`s the thanks I`m getting. You may think that this test is required by law for ALL climbing frames, but unfortunately this is not the case, so if you are considering buying elsewhere, it is always worth checking that climbing frames are independently tested in accordance with EN71 regulations. Damn. I thought it was the same thing.
