Yahya had already asked Judge Abdus Sattar to prepare the electoral lists within the time limit. As this was the first parliamentary election in the country on the basis of one man, one vote, there was no previous data, so caution was advised in coordinating all the functions of the electoral commission. The first task was to draw up the electoral lists with the names of those who had reached the age of 21 on 1 October 1969. The first draft was published on January 16, 1970, and with minor corrections, the final list appeared on March 17. The Speaker, the Deputy Speaker and other Members are entitled to such allowances and privileges as the Speaker may impose by regulation. (3) The exercise by an officer of the National Assembly of the powers conferred on him to regulate procedure, conduct business or maintain order in or in connection with the work of the Assembly is not subject to jurisdiction. On April 4, 1970, President Yahya visited Dhaka to assess the political situation and meet with its political leaders. He assured them that the LFO was just a «formality.» This Ordinance shall apply notwithstanding anything to the contrary in the Provisional Constitutional Decree, the Constitution of the Islamic Republic of Pakistan of 1962 or any other law currently in force. To express his intention to hold free and fair elections, Yahya Khan has taken many decisions. Perhaps he wanted to wash away the stains that the military-led government had washed away over the past 11 years. In implementing its plan and legally covering its future actions, it announced a Legal Framework Ordinance 1970 (LFO) on 30 March 1970.
The LFO was a provisional constitution and had many guidelines for organizing elections and determining the future character of the newly elected assembly. The sun of the 1970 New Year rose with new enthusiasm in Pakistani politics. The ban on political activity was lifted and everyone was optimistic about the evolution of the situation, except for the few unfortunate events that took place after the elections. Political parties were allowed to launch their election campaigns, which set the whole nation in motion. All factions, large and small, joined the race. The loophole created by Yahya was at the LFO. The meaning of the LFO has been understood by political parties. It was published at a later date on March 30, 1970 for understanding.
The General Mass never paid attention to this document, as it had nothing to do with the daily life of a person in Pakistan. Since political activities were not allowed at that time, there were no comments on the LFO published by the political parties. Yahya`s draft LFO was Greek until it was available as a document. Although the regulation deals mainly with electoral procedures, it can nevertheless be considered a constitutional milestone, since in this order the principle of adult suffrage has been reintroduced to encourage the direct election of the legislative and executive powers. In addition, the Order has provided some basic principles for the country`s future constitution. There were also opposing views on various aspects of the LFO, but there were four areas where legal experts had substantive reservations. These are: The LFO stated that if the Constituent Assembly could not draft a constitution within the time limit, the Assembly would be dissolved and new elections would be held; the President would reject any constitution drawn up by the Assembly if it did not meet the conditions specified in the LFO; the President would have the power to interpret and amend the Constitution; and that his decision could not be challenged in any court. (1) Muslims in Pakistan should be able, individually and collectively, to organize their lives in accordance with the teachings of Islam as set forth in the Holy Qur`an and the Sunnah; and 3: Elections to the National Assembly were held on 5 October 1970 and those of the provincial assemblies by 22 October at the latest. It also issued a Legal Framework Ordinance (LFO), which dissolved West Pakistan`s single entity and restored Pakistan`s original four provinces – namely Punjab, Sindh, North West Frontier Province and Balochistan.
